Dealing With The Stress of Cerebral Palsy

If a child is diagnosed with cerebral palsy then the road ahead for the fathers, mothers, and/or guardians of the child can look like it is very challenging at times. That's not surprising because when a child has cerebral palsy it can put the whole family under a great amount of stress and duress.

If a child's motor functions aren't normal and don't look as if they will be getting better a doctor might diagnose the child as having cerebral palsy. Typically, cerebral palsy is verified in children before they are three years old.

Cerebral palsy is caused by brain damage that occurred either during pregnancy, birth, or shortly after the child was born. The brain damage causes neurological problems. Consequently the child loses control of his or her body and their movements. Their muscle tone deteriorates and their speech can sometimes seem unintelligible.

If you have been recently told about your child's disability then you are probably feeling great sorrow, a lot of pain, and a certain amount of fury as the reality of what your baby will have to go through in his or her life begins to set in.

The brain injury may have been caused by the negligence of a medical professional.

If that is the case, then you might have the right to receive monetary damages. With the costs of caring for a baby who has cerebral palsy rising almost daily, it could be a bit of a relief knowing that you have the right to receive money from the person (or people) who caused your baby's injury.

With an attorney's help you will be able to determine if the brain injury was caused by any of the following situations. And, if one of these warning signs were present, then the attorney will be able to pursue a legal recourse.

• Failing to perform or a delay performing a C-section

• Misinterpreting or failing to perform specific tests while you were pregnant

• Failing to have the right specialist(s) present during the baby's delivery

• During pregnancy, failing to detect abnormal amniotic fluid levels

• Failing to treat RH incompatibility

• Failing to act on symptoms of encephalitis or meningitis

• Not recognizing fetal distress or addressing it incorrectly

• Failing to provide or confirm a measles vaccine if you were likely to get pregnant

• Incorrectly applying vacuum extraction or prolonging the extraction

If your baby does have cerebral palsy and you think that it was caused by negligence then you should contact an attorney who specializes in this area of the law.
